General
Payment for a trip is to be made in full before any trip. Skippers Canyon Gold reserves the right to update the trip rates listed on its website at any time without notice. The minimum age to participate on a trip is three. A child rate applies for minors 3-15 years old. All children must be accompanied by a paying adult.
Skippers Canyon Gold requires a minimum number of two clients (paying adults rate) to confirm all trips. On NZ statutory holidays, the minimum client’s number (paying adult rate) may increase to four clients to confirm a trip.
Skippers Canyon Gold reserves the right to amend timetables and to suggest other dates, for instance if only a single person is participating on a trip on any day.
Skippers Canyon Gold reserves the absolute right to decline to accept any person as a member of a trip prior to such trip or on departure (including, but not limited to due to intoxication, being affected by drugs, abusive behaviour, client appearing unsafe or presenting obvious risk to themselves or others). Skippers Canyon Gold reserves the right to refuse participation to a client, without refund. This policy is for the safety and comfort of the client concerned, other clients and Skippers Canyon Gold staff, vehicles and equipment. Skippers Canyon Gold’s decision is final on client’s participation in our trips.
Skippers Canyon Gold welcomes and actively encourages disabled clients. Unfortunately, due to some safety regulations or logistical issues this may not always be possible. Clients are encouraged to please contact Skippers Canyon Gold to discuss options with our staff beforehand if you think there may be issues relating to any disability, and if possible Skippers Canyon Gold will look to find a solution to address the needs of these person/s. Skippers Canyon Gold will make the final decisions on whether a client is able to participant in a trip considering each individual case based on safety.
All clients agree to the use and marketing of all videos and still images captured by Skippers Canyon Gold and its subsidiaries.
As our trips operate in a back country environment, clients are strongly advised to dress appropriately for colder temperatures and the outdoor setting. In addition, all clients must adhere to the environmental responsibility code of ‘pack in – pack out’ for any litter.
Skippers Canyon Gold trips are conducted in English, and while we encourage a natural flow of conversation, we ask that clients refrain from extensive translations during the experience. This ensures that everyone can enjoy the trip seamlessly and fully immerse themselves in the experience.
Clients acknowledge that during the trip they will be and remain under the absolute control of Skippers Canyon Gold and that the direction and control of the vehicle and its crew is at all times the sole responsibility the Skippers Canyon Gold guide and/or staff member.
Due to operational circumstances Skippers Canyon Gold reserves the absolute right to change advertised vehicle type or equipment supplied for a trip.
In the event of a booking for a private trip, the client acknowledges that this will require a 50% deposit on booking and the remaining 50% deposit must be paid 7 days prior to the departure date to confirm the booking.
The client acknowledges that Skippers Canyon Gold accepts no responsibility for loss or damage to the client’s personal property whilst on any trip.
All Prices and transactions are in New Zealand dollars (NZD). Due to exchange rate fluctuations, at times there may be some variance. A variance my also occur in amounts refunded compared to the amount initially charged (if relevant). Skippers Canyon Gold does not accept any liability for these variances or any subsequent credit card/bank charges relating to these transactions.
Cancellation Policy
Skippers Canyon Gold reserves the right to cancel a trip due to circumstances beyond our control or in the event of unsuitable road or weather conditions, in such cases any deposit or full payment will be refunded. Clients will be advised by Skippers Canyon of any cancellation as soon as reasonably possible prior to the departure time of the trip. The client acknowledges however, once a Skippers Canyon trip has entered the Skippers Canyon, no refunds will be given. The client further acknowledges that Skippers Canyon Gold guides and drivers may modify their routes, or shorten a trip if weather conditions unexpectedly change. Reasons for this could include, but are not limited to, excessive rain causing risk of flooding, high winds, treefall, snowfall, ice, lightning strike, other extreme environmental or weather event, such as earthquake, landslide, wildfire, tsunami, cyclone, volcanic eruption.
For trips cancelled by clients more than seven days prior to departure time, there will be a full refund less a transaction processing fee.
For trips cancelled by clients within seven days prior to departure time, or in the case of a ‘no show’, there is no refund.
In the event the client has booked a trip with Skippers Canyon Gold through a third-party booking agent in the event of any requested refund the client should refer to the agent’s terms and conditions.
Hazards
Whilst Skippers Canyon Gold undertake all reasonably practicable steps to minimize, remove, or isolate risks during our trips, it still exists as it does in everyday life. Any off road / back country driving can be hazardous and lead to unexpected incidents. This can include but is not limited to - accidents, injuries, vehicle damage, property damage and loss of life. All clients accept that they may be exposed to the following risks during a trip, including but not limited to:
motor vehicle accident including collision with other vehicles, stationary objects, or the land, rollovers, or vehicle fires;
client failure to heed safety warnings, both verbal and written;
actions of other road users or members of the public which could cause harm;
the risk of falling or injury due to uneven, loose, or slippery terrain;
the risk of drowning;
injury or death due to natural events such as excessive rain causing risk of flooding, high winds, treefall, lightening, blizzards, snowfall, ice, lightning strike, other extreme environmental or weather event, such as earthquake, landslide, wildfire, tsunami, cyclone, volcanic eruption and any ongoing consequences of these events; and
other similar risks to the above.
Limitation of Liability
As detailed above, the client acknowledges that off-road driving / back country driving can be hazardous and lead to unexpected incidents. To the fullest extent permitted by law, Skippers Canyon Gold accepts no liability for any act or omission arising from a trip (including but not limited to circumstances beyond our control a trip not taking place, delays, interruptions or changes due to weather conditions, technical problems or other breakdowns in arrangements ) and the client indemnifies, releases, waives and holds harmless Skippers Canyon Gold, its officers and/or its employees from all claims, losses, damages or expenses that he or she or their executors, administrators, next of kin, successors or assignees may have or which may arise during or in conjunction with a trip provided by Skippers Canyon Gold. This includes any claims for damage caused by negligence of Skippers Canyon Gold, its officers and/or its employees, and includes any claim for any costs including legal fees that may be incurred as a result of any such claims, losses, damages or expenses whether valid or not.
Skippers Canyon Gold does not accept any liability for the acts, omissions, or default whether negligent or otherwise of those companies or other persons providing services in connection with a trip. The client agrees that any independent contractors with whom Skippers Canyon Gold contracts provide their services subject to their usual terms and conditions.
Without limiting the above, Skippers Canyon Gold shall be under no obligation or liability to any person as a result of any inaccuracy, inaccurate description or changes to any trip made by Skippers Canyon Gold or any other party.
To the fullest extent permitted by law, Skippers Canyon Gold has no liability for losses or additional expenses incurred by clients due to sickness, weather, strikes, delays or changes in air or other transport services, force majeure, acts of God, or other causes outside the control of Skippers Canyon Gold.
Statutory Protections – New Zealand Law
These terms and conditions are to be read subject to the provisions of the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 and do not affect the client’s rights as expressed in the Acts.
Privacy
All and any information provided to Skippers Canyon Gold will be treated in accordance with our Privacy Policy accessible here Privacy Policy. By purchasing a ticket for a trip with Skippers Canyon Gold the client consents to the collection, storage, use and disclosure of your personal information in accordance with our Privacy Policy.
Acceptance of Terms and Conditions
By purchasing a ticket for a trip with Skippers Canyon Gold, the client acknowledges they have read all the above Terms and Conditions and agrees to be bound thereby.
To the extent permitted by law, Skippers Canyon Gold reserve the right to change any terms contained in these Terms and Conditions at any time.
